Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("User", "you", "your") and IOCODO LLC ("we", "us", "our"), the operator of Bolt Duel. They govern your access to and use of the Bolt Duel application and its online services (the "Service"). By downloading, accessing, or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

Service: Bolt Duel, a real-time multiplayer card duel game inspired by Speed (also known as Spit), together with its features and the online infrastructure that runs it.
Content: the display name you choose and any other material you submit through the Service.
User: any person who accesses or uses the Service.

2. Eligibility

You must be at least 13 years old, or the minimum age that applies where you live, including 16 where local law requires it, and legally able to enter into a binding agreement. By using the Service you confirm that you meet these requirements. The Service is not directed to children below that age, and we do not knowingly collect personal data from them. See our Privacy Policy.

3. Accounts

You can play against the bot as a guest without an account. Online matchmaking, the global leaderboard, and saved progress require a sign-in through one of the supported providers: Google Sign-In, Sign in with Apple, or email and password. Guest sessions use an anonymous identifier.

You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for everything that happens under your account. Tell us promptly if you believe someone else is using it. We may refuse, suspend, or close accounts that break these Terms or that we reasonably believe are used for abuse or fraud.

You can delete your account and its data at any time from Settings, under Delete Account, or by writing to support@iocodo.com.

4. Display names

Your display name is visible to the players you are matched against and to everyone who opens the global leaderboard, so choose it accordingly. It must not impersonate another person, infringe anyone's rights, or contain unlawful, hateful, sexual, or otherwise objectionable material.

Your display name can be changed once, from the profile screen. After that it is fixed, so pick one you are happy to keep.

Reporting a name

We do not tolerate abusive or objectionable content. Bolt Duel has no chat and no player-to-player messaging, so the display name is the only thing one player can show another. If you see a name that breaks the rule above, send it to support@iocodo.com and we will review it within 24 hours.

When a report is upheld we may reset the name, restrict features, suspend the account, or close it, depending on what the case calls for.

5. Fair play

Bolt Duel is a reaction game with a shared ranking, so fair play is the whole point. You must not:

use bots, macros, scripts, or any automation to play on your behalf;
modify the app, tamper with game state or network traffic, or exploit a defect to influence the outcome of a match or your rating;
arrange matches whose result is agreed in advance in order to move ratings;
create multiple accounts to farm results, evade a suspension, or distort the leaderboard;
interfere with the availability or integrity of the Service or its infrastructure.

Your rating and your place on the leaderboard are part of the game, not property and not a prize. Where we detect manipulation we may correct or reset a rating, remove entries from the leaderboard, and restrict or close the accounts involved.

6. Acceptable use

Beyond fair play, you agree not to use the Service for any unlawful or unauthorised purpose, not to harass, threaten, defame, or impersonate anyone, not to distribute malware, and not to scrape, copy, decompile, or reverse-engineer the Service except where mandatory law allows it. We may suspend or end your access if you breach this section.

7. Your content and the licence you grant

You keep ownership of the Content you submit. By submitting it you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to store, reproduce, display, and transmit that Content for the sole purpose of running and improving the Service, which in practice means showing your display name to the players you meet and on the leaderboard. You confirm that you hold the rights needed to grant this licence. We may keep copies where the operation of the Service, the law, or the enforcement of these Terms requires it, as described in our Privacy Policy.

8. Our materials

The Service, including its software, design, artwork, text, sounds, and logos, belongs to us or to our licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own personal, non-commercial use under these Terms. You may not copy, modify, distribute, sell, or build derivative works from it without our written consent, except where the law says otherwise.

Speed, also known as Spit, is a traditional card game in the public domain. Bolt Duel is our own implementation of it and is not affiliated with, endorsed by, or sponsored by any other publisher of a game with a similar name.

9. Price and payments

Bolt Duel is free to download and free to play, and it does not currently offer in-app purchases or subscriptions. If we introduce a paid item, a subscription, or advertising at some point, we will describe it in an updated version of these Terms and of our Privacy Policy before it applies to you, and the price and conditions of any paid item will be shown at the point of sale.

Any purchase you ever make would be processed by Apple or Google through the store you installed the app from, under that store's own terms. Refunds are handled by the store rather than by us, in line with the store's refund policy and with your statutory rights.

10. Availability and changes to the Service

Online matchmaking, the leaderboard, and saved progress need a working internet connection and depend on servers we run on third-party infrastructure. We do not promise that the Service will always be available, and we may add, change, suspend, or discontinue features, including online play, at any time. Where a change is significant and we are able to, we will give notice in the app or by email.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO THE ABOVE EXCLUSIONS APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, RATING, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED EUROS (EUR 100), WHICHEVER IS GREATER. NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. CONSUMERS IN THE EUROPEAN ECONOMIC AREA AND IN OTHER JURISDICTIONS WITH MANDATORY CONSUMER PROTECTION LAWS KEEP ADDITIONAL RIGHTS THAT CANNOT BE WAIVED BY CONTRACT, AND THESE TERMS DO NOT AFFECT THEM.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents against any claim, damage, loss, liability, cost, or expense (including reasonable legal fees) arising out of your use of the Service, your Content, your breach of these Terms or of applicable law, or your violation of any third-party right. We may assume the exclusive defence and control of any matter you would otherwise indemnify, at your expense.

14. Termination

You may stop using the Service at any time and delete your account as described in section 3. We may suspend or end your access, or close your account, with or without notice, if we believe you have breached these Terms or the law, or if we discontinue the Service. When your access ends, your right to use the Service ends immediately. The sections that by their nature should outlive the agreement, including sections 7, 8, 11, 12, and 13, survive termination. We may keep and use information as described in our Privacy Policy.

15. Changes to these Terms

We may update these Terms. The "Last updated" date at the top shows when they were last revised, and the revised version is posted on this page. If you keep using the Service after a change takes effect, you accept the revised Terms. If you do not accept them, stop using the Service. For material changes we will give additional notice, in the app or by email, where the law requires it.

16. General

Governing law: these Terms are governed by the law of the country where you live, save that (i) if you are a consumer the mandatory consumer protection law of your jurisdiction applies, and (ii) where permitted we may apply the law of a specific jurisdiction to users who are not consumers. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Disputes: any dispute about these Terms or the Service is to be resolved in the courts of your jurisdiction to the extent mandatory law requires. Consumers in the European Union may also use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Severability: if any provision is held invalid or unenforceable, the rest stays in force.
Entire agreement: these Terms, with our Privacy Policy and any additional terms we present for a specific feature, are the whole agreement between you and us about the Service and replace any earlier one.
Waiver: if we do not enforce a right or a provision, that is not a waiver of it.
Assignment: you may not assign or transfer these Terms without our written consent. We may assign ours without restriction.
Apple: if you installed Bolt Duel from the App Store, these Terms are between you and us, not with Apple. Apple has no obligation to provide support for the app and is not responsible for any claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
